Terms & Conditions
1. Scope
These terms apply to all services between the contractor and the client.
Important: This activity is carried out as a private hobby project without a business license and without commercial intent.
2. Subject Matter
All services relate exclusively to virtual goods and digital services:
- Software development, code, systems, configurations, digital assets
- Installation, configuration, system integration, source review, error analysis
- Stack: C++, Python, CSS, JavaScript
- Systems: FreeBSD, Linux, MariaDB
No physical goods are offered or delivered.
3. Contract Formation
A contract is concluded through written acceptance of the offer (including via Discord). No oral side agreements exist.
4. Compensation & Payment
Price and integration depend on the system, package, requirements, and scope. Please reach out via Discord.
- Payment via PayPal, credit card, or cryptocurrency
- Small projects: payment upon completion
- Larger projects: 30% deposit, remainder upon completion
- Payment term: 14 days after invoicing
5. Client Obligations
- Provide necessary information and access credentials
- Respond to inquiries promptly
- Maintain backups independently
6. Warranty
- Period: 6 months from acceptance
- Defect notice: Promptly in writing
- Right to repair; after two failed attempts: reduction or withdrawal
7. Liability
- Intent and gross negligence: unlimited liability
- Simple negligence: only for essential contractual obligations
- Liability cap: maximum contract value, up to EUR 1,000
- The client is responsible for their own backups
8. Copyright & Usage Rights
- Developed software transfers to the client upon full payment
- Anonymized code snippets may be used for portfolio purposes
- Third-party open-source licenses remain unaffected
9. Confidentiality
- All project information and access credentials are treated confidentially
- Passwords are stored encrypted and deleted after project completion
- Data processing in accordance with GDPR (see Privacy Policy)
10. Retention & Deletion
Project data is retained for 3 months after completion, then deleted. The client may request a copy.
11. Termination
- Ordinary termination: 7 days notice
- Extraordinary termination for serious contract violations
- Services already rendered are compensated proportionally
12. Right of Withdrawal
As this is a non-commercial activity involving exclusively virtual goods, the statutory provisions apply accordingly.
13. Severability Clause
Invalid provisions shall be replaced by valid ones that most closely reflect their economic purpose.
14. Applicable Law
German law applies. Place of jurisdiction: residence of the contractor.
